Web Site Hosting Terms & Conditions

Payment of services constitutes agreement with the following web site development, web site hosting and domain management Terms & Conditions.

Requirements Definition

Northern Computer Service, Inc. will conduct requirements definition by meeting with the Customer or appropriate Customer representative(s) to clearly define the look and feel, functionality, content, and security access requirements for the new Customer Internet web site.

Digital Certificate Secure Socket Layer (SSL) Services

SSL (Secure Sockets Layer) is the standard security technology for establishing an encrypted link between a web server and a browser. This feature ensures that all data passed between the web server and browsers remain private and integral. SSL is an industry standard and is used by millions of websites in the protection of the privacy of online transactions and web site visitor information. SSL connections requires an SSL Certificate.

This feature is generally only required for web site shopping cart services were credit card information is collected. However, other agencies or services may require Digital Certificate SSL Services. For example, the collection of HIPPA, Social Security Card information or other sensitive information may require Digital SSL Services. It is the Customer's responsibility to inform Northern Computer Service, Inc. if these Digital SSL services are required.

Northern Computer Service, Inc. will provide the necessary SSL security through the NCS web servers and obtain the appropriate third-party SSL certificate to allow credible secure browser connections.

Parallel Web Site Hosting

If the Customer has an existing web site, Northern Computer Service, Inc. will maintain the hosting and availability of the existing web site. At the same time, Northern Computer Service, Inc. will develop the new web site simultaneously using a similar domain name (e.g. new.domainname.com). At any time, the Customer may visit the new web site online to see the progress and provide feedback to Northern Computer Service, Inc.. Upon Customer's satisfaction with the new web site, the new web site will replace the legacy business web site and the new web site will be hosted under the correct Customer domain name.

Web Site Design

Northern Computer Service, Inc. will design the new Customer Internet web site according to the requirements and functionality defined in the requirements definition process. Northern Computer Service, Inc. will provide at least 2 web site reviews/demonstrations to Customer representatives in progressive phases during the development of the web site to ensure content and desired functionality requirements are being met.

Customer understands that some requirements may not be technically possible. If requirement(s) conflicts occur, both parties agree to meet and come to reasonable technology or functionality alternatives.

Web Site Development

The web site will be developed using open standards (non-proprietary methods) in the event that Customer elects to move the web site to alternative hosting providers in the future. A domain name transfer charge of $49.99 may apply.

The Customer agrees that the use of Hypertext Markup Language (HTML), Hypertext Preprocessor (PHP), Common Gateway Interface (CGI), JAVA, and Open Source products are acceptable for use in the development of the new Customer Internet web site.

Web Site Graphics and Logo Design

Web site graphics (placement of product pictures, scanning of existing images, and minor digital retouching of existing graphics or artwork) is included in the formal proposal and cost estimate. Cost for extensive graphical services such as business logo design, or photo/video manipulation or conversion may not be included in the formal cost proposal. Extensive graphic, video or logo design support in any capacity is a $75 per hour charge. There is a one-hour minimum requirement.

Web Site Hosting

Under this agreement, Northern Computer Service, Inc. will transfer requirements and functionality concepts into a production Internet web site. The web site will be accessible worldwide on the Internet 24-hours a day and 7-days a week, with exception to any situation that may be identified in the Deviations & Exceptions section of this agreement.

Northern Computer Service will provide computer hardware resources and up to 5 Gigabytes of disk drive storage space to host the new Customer Internet web site(s).  Northern Computer Service agrees not to set Quality of Service (QOS) restrictions on the new Customer Internet web site.  Northern Computer Service further agrees to provide sufficient hardware, software, and connectivity resources to support up to 50 simultaneous visitor connections to the new Customer Internet web site.

Web site hosting fees will accrue monthly and billed to the Customer annually.

Domain Name Managment

Northern Computer Service will, at Customer request, transfer the Customer’s existing domain name from a third-party registrar to Northern Computer Service web servers. Domain name transfer is $49.99. Annual domain name registration is $49.99 per year.

Domain names purchased through Northern Computer Service, Inc. are automatically renewed annually. It is the Customer’s responsibility to contact Northern Computer Service, Inc. to cancel domain name services at least 60-days prior to the scheduled domain name renewal. Once a domain name has been renewed, the purchase cannot be cancelled and the annual renewal fee of $49.99 is billed to the Customer.

Domain names purchased through a third-party registrar are the the responsibility of the Customer.

Domain names registered through Northern Computer Service, Inc. that have been abandoned become the property of Northern Computer Service, Inc. Domain names that are rescued by Northern Computer Service, Inc. become the property of Northern Computer Service, Inc. Unpaid domain names, or domains with unpaid domain name renewal fees become the property of Northern Computer Service, Inc.

Email and Email Relay

Northern Computer Service will provide up to 5 email accounts, which are accessible via Web-Based Mail, POP3, and IMAP mail readers (Outlook, Thunderbird, Livemail, etc) or provide email relaying from the Customer web site to the desired Customer third-party email address(es).

Internet Connectivity

Northern Computer Service will provide the new Customer Internet web site with up to 5Mbps (Download) and 5Mbps (Upload) connectivity through the use of a commercial-grade communication lines.

Browser Compatibility

Northern Computer Service will use development standards that support modern web browser applications. This means that the Customer web site will display properly in modern versions of Internet Explorer, Chrome, Firefox, and Safari. Old browser technology may not display the Customer web site properly. If Customer requires backwards compatibility with non-current browser applications, additional development costs may apply. Please note that some features may not be compatible with Apple Macintosh products regardless of current technology.

Web Site Backup/Recovery

Northern Computer Service, Inc. will perform automated weekly data backups of the Customer's Internet web site maintaining a 30-day backup history for quick recovery in the event of a disaster or undesired modification to the web site. Additional backups, or more frequent backups, may be conducted by the Customer or the Customer may request additional web site backup services for an additional charge.

Search Engine Submission and Optimization (SEO)

If requested by the Customer, Northern Computer Service, Inc. will optimize the website using multiple software tools and brain-trust experience to configure the site, links, photographs, and META TAGS in a manner that is optimal for search engine ranking. This DOES NOT GUARANTEE TOP WEB SITE RANKING. While these services will assist the ranking process, search engine ranking requires active participation from the Customer, social media participation, and increased traffic to the Customer web site.

Northern Computer Service, Inc. WILL NOT employ or allow the use of fake traffic generators, malicious scripts or programs that mis-represent a Customer web site, or third-party traffic generating businesses. These activities will result in termination of services by Northern Computer Service, Inc. and can result in penalties or a life-time ban by the major commercial search engines.

Northern Computer Service, Inc. will submit the Customer's Internet web site domain name to major search engines, to include Yahoo, Google, BING, MSN.

Web Site Technical Support

During the development period, Northern Computer Service, Inc. will provide technical support via phone, in person, or email to the extent necessary to carry out the design, development, training, and publishing of the new Customer Internet web site.

After the development period, Northern Computer Service, Inc. will provide a one-time training session to train the Customer in using the web site tools to update/modify the Customer's web site.

Additional web site training is chargeable at $75/hour, billed in half-hour increments. Any additional web site modifications, or routine web site maintenance is chargeable at the rate of $75/per hour, billed in 10 minute increments.

Work Not Identified In The Formal Proposal

In the formal proposal, Northern Computer Service, Inc. will identify and defined the tasks and associated costs for producing the Customer Internet web site(s). Any additional work, requirement changes, design modifications, training, or other requests for the web site above and beyond what is defined in this document is subject to a general labor rate of $75 per hour (half hour minimum) or other rate advertised by Northern Computer Service, Inc. for specific services listed at www.ncswi.com

Deviations and Exceptions

Northern Computer Service, Inc., to the best of its ability, will ensure 24/7 accessibility to the new Customer Internet web site. There are circumstances beyond Northern Computer Service’s control that may prevent access to the Customer Internet web site. These circumstances include, but are not limited to, problems with major communication trunk lines (Verizon, Charter, AT&T, CenturyTel, etc), outages due to weather, hardware/equipment failure, or other acts of God. Northern Computer Service, Inc. will not be held liable or accountable for connectivity issues outside the control of Northern Computer Service, Inc..

Right to Terminate or Suspend Services

Northern Computer Service, Inc. reserves the right to terminate this agreement or cancel services for any reason. More commonly, Northern Computer Service, Inc. reserves the right to terminate any of the services provided to Customer where:

  • Services provided by Northern Computer Service, Inc. are found to support offensive, racial or illegal activities.
  • Services provided by Northern Computer Service, Inc. are found to violate the Terms of Service (TOS) of Charter, Verizon, AT&T or CenturyTel.
  • Services provided by Northern Computer Service, Inc. are found to violate the Terms of Service (TOS) of Northern Computer Service, Inc..
  • Services provided by Northern Computer Service, Inc. are found to involve terrorist activities.
  • Services provided by Northern Computer Service, Inc. are found to illegal pornographic activities.
  • Services provided by Northern Computer Service, Inc. are found to violate any national or international law.

Additionally, NCS reserves the right, without notification of customer, to suspend any website and/or email services when customer payment for hosting or domain name services is delinquent. 

Domain Name and Web Site Ownership

Northern Computer Service, Inc. may establish, procure, transfer, activate or configure one or more domain names on behalf of the Customer. Any and all domain names purchased for the purpose of this Customer’s web site is considered the property of the Customer, with any exception(s) outlined in the Deviations & Exceptions section of this agreement.

If at any time the Customer chooses to move the web site to another hosting provider, transfer the domain name(s) to another registrar, or sell the domain name, Northern Computer Service, Inc. will cooperatively assist in this transfer in a timely manner. A transfer fee of $49.99 for each domain transfer may apply and is the responsibility of the Customer. All domain transfer fees are required to be paid, in full, before release of domain(s) to a third-party registrar. Domains names that are abandoned, domain names with unpaid renewal fees, or domain names rescued by Northern Computer Service, Inc. become the property of Northern Computer Service, Inc.. NCS reserves the right to release any domain name(s) that are abandoned or unpaid by the Customer or Customer Representative.

Billing and Payment Schedule

All web site development projects require a 60% down payment deposit prior to work being performed. All balances are due upon completion of the web site project or within 7-days of the date of the final invoice, unless other specific payment options have been agree to by Northern Computer Service, Inc., which will be documented in a section entitled Alternative Billing and Payment Schedule.

Payment of any Digital Certificates must be paid in full prior to implementing SSL or security services.

Payment may be made with personal check, company check, bank check, credit card, or money order.

There is a $50.00 fee for all returned checks. All payments are due within 7-days of invoice date. Late payments are subject to an additional fee as authorized by the state of Wisconsin.

Changes to this Proposal

Northern Computer Service, Inc. and the Customer(or legal Representatives) must approve any additions, changes, modifications, or deviations to the work, tasks, or costs outlined in the formal proposal in writing as an amendment to the original proposal document.
